When Do You Need a Party Wall Surveyor?

Understanding when to involve a Party Wall Surveyor is crucial. If you plan to undertake any building work near or on your shared property boundary, or ‘Party Wall’, in England and Wales, the Party Wall Act mandates that you inform your neighbours. Party Walls, whether forming part of a building or not, require notification. This includes structures like garden walls (excluding wooden fences) and walls on one owner’s land used by other owners to separate their buildings.

Examples of work that necessitate notification and potential surveyor involvement include building a new wall, cutting into a party wall, altering the height or depth of a party wall, removing features from a party wall, or rebuilding a party wall.

 

 

The Party Wall Surveyor Appointment Process:

In cases where an agreement cannot be reached or additional protection is sought, the appointment of a Party Wall Surveyor becomes imperative. This can be a joint decision with your neighbour or individual appointments. The appointed surveyors collaboratively determine the terms of a ‘Party Wall Award,’ specifying the nature, timing, and financing of the work, including the surveyors’ fees.

It’s important to note that Party Wall agreements differ from planning permission or building regulations approval, emphasising the need for specialised expertise in navigating this legal landscape.
